Introduction
In this workshop we look at some important provisions in the JBCC NSSA agreements as the provisions of the subcontract agreement has important implications for the employer and his agent as well as the contractor. Material is presented in an interactive manner, through case studies and practical examples.
Topics That Will Be Covered
Some of the issues to be considered under the N/S include the following:
- Different types of subcontractor recognised by JBCC;
- Remedies given to main contractor when subcontractor delays or breaches;
- Design responsibility;
- Programming the work of subcontractors under JBCC;
- Contractor's instructions;
- Stages of completion with particular focus on interim completion;
- Damages for non-performance vs penalties;
- Termination of the subcontract agreement.
Some of the issues to be considered under the MWA include the following:
- When to use the MWA;
- Role of the Employer’s Agent;
- Claims for extension of time;
- Penalties;
- Termination.
Outcomes Of The Workshop
Delegates will gain an understanding of the overall structure of the JBCC suite of documents and how to use the NS and MWA within the context of a project.
The Presenter
Roelf Nel
Roelf Nel obtained his degree cum laude from University of Pretoria. He is a practicing attorney, specializing in Construction and Engineering Law. His company, Buildforce provides consulting services to all role players in the built environment.
Roelf regularly presents CPD accredited workshops, as well as interactive work sessions at University of Pretoria. Roelf lead discussions on the Topic of “Mediation in Architecture” at Bloembuild Expo 2016, presented by SAIA Free State. Roelf presented several topics at the PIA professional practice program.
He regularly presents for the Pretoria Institute of Architects (PIA), the Gauteng Institute of Architects (GIFA), Free State Institute of Architecture Master Builders South Africa North (MBSA) and the Royal Institution of Chartered Surveyors (RICS).
He is a RICS accredited civil commercial mediator and serves on the RICS Presidents Panel of mediators. He also serves on the RICS Arbitrators and Adjudicators panel. He also serve on South African Institute of Civil Engineers (SAICE) presidents panel.
Roelf has a passion for training and his vibrant presenting methods, knowledge, and approach is making him a sought after presenter in the built environment.
